The Court of Protection is there for those people whose finances or welfare need to be managed for them. This may occur for example in an elderly patient who has suffered a stroke or whose dementia has reached the stage where they have lost the capacity to manage their own affairs. The responsibility then falls on the family to make decisions. This is where Dickson Haslam can make an application to the Court of Protection on your behalf, allowing you the ability to protect your relative’s assets as far as you are able.
In some situations the relative may be able to request that their affairs are looked after for them, in which case they can apply for a Lasting Power of Attorney (LPA). The team at Dickson Haslam can do this for you, ensuring a smooth transition in the management of affairs and the minimisation of financial loss. This is particularly important when under pressure from the local authority to sell your relatives assets to pay care home fees. It is also vital to move quickly when assets are inaccessible after a sudden loss of capacity, i.e. a stroke, because until these matters are sorted out the relatives are unable to access bank accounts.
